Accused Kulwinder Singh Makhni and accused Jasmeet Kaur @ Jasmeet Makhni with Sh. G.P.S Baweja Advocate and Sh. R.S Baweja Advocate. ORDER:- Today, both the accused namely Kulwinder Singh Makhni and accused Jasmeet Kaur @ Jasmeet Makhni appeared and surrenderd in this case. Both the accused have filed two separate applications for bail and acceptance of the bail bonds in compliance of the order dated 27.04.2021 passed by Ms. Harinder Sidhu, Ld. Special Judge, CBI, Punjab. Notice of the application was given to the CBI through Ld.PP who is present in the Court. No written reply was filed by the CBI. Report of Ahlmad was called. The Ahlmad of the Court has confirmed the order dated 27.04.2021 passed by Ms. Harinder Sidhu, Ld. Special Judge, CBI, Punjab. Both the bail applications be registered in the relevant register as well as in CIS under Rules. Perusal of the order reveals that Ld. Special CBI Vs. M/s Punjab Basmati Rice Ltd. And Others 2 of 3 Judge, CBI, Punjab, had directed both the accused/applicants namely Kulwinder Singh Makhni and accused Jasmeet Kaur @ Jasmeet Makhni, to surrender before the instant Court today i.e. 29.04.2021 and the instant Court had been directed to admit both the above named accused to bail on conditions as being appropriate during the trial. In compliance of the order dated 27.04.2021 passed by Ld. Special Judge, CBI, Punjab the applications filed by accused namely Kulwinder Singh Makhni and accused Jasmeet Kaur @ Jasmeet Makhni are hereby allowed and both the said accused are admitted to bail subject to their furnishing bail bonds in the sum of Rs.1,00,000/- each with one surety each in the like amount subject to the condition that the accused shall not leave India without prior permission of the Court and shall appear to face trial without fail. Surety of accused Kulwinder Singh Makhni has furnished an FDR bearing A/C No.971100PU00002470 of amount of Rs.1,00,000/- of the Punjab National Bank, branch DAC, Sector 76, Mohali, (Branch Code 971100) which is in the name of Sh. Tarandeep Singh Bajaj son of Gurcharan Singh, resident of House No.68, Holy City Office, Near Gumtala Bye Pass, Amritsar-I, Punjab and Surety of accused Jasmeet Kaur @ Jasmeet Makhni has furnished an FDR bearing A/C No.971100PU00002489 of amount of Rs.1,00,000/- of the Punjab National Bank, branch DAC, Sector 76, Mohali, (Branch Code 971100) which is in the name of Sh. Vikram Singh Makhni son of Ranjit Singh Makhni, resident of House No.5, R.B Duni Chand Road, Near Ganpati Tower, Lawrence Road, Amritsar-I, Punjab. Ld. Counsel for the accused contended that the surety in nature of FDR is readily available with both the accused today and the accused are ready to furnish surety in the form of immovable assets but as both the accused are from Amritsar they be CBI Vs. M/s Punjab Basmati Rice Ltd. And Others 3 of 3 granted sometime to furnish surety in the form of immovable assets keeping in view the restrictive working in most of the State Government Offices and precautionary measures to curtail the Covid-19 Pandemic. In view the prayer of Ld. Counsel for both the accused and taking notice of the rising second wave of Covid-19 Pandemic, the prayer is granted. Today, the surety furnished by both the accused in the nature of FDRs is accepted and attested with the directions that both the accused shall furnish the requisite surety bonds in the nature of immovable assets on the next date fixed in the case. The original FDRs be kept by the Ahlmad in the safe custody and the intimation to this effect be also sent to the concerned bank. Bail bonds/surety bonds have been accepted and attested by this court and the accused namely Kulwinder Singh Makhni and accused Jasmeet Kaur @ Jasmeet Makhni are released on bail.
