21012020 Dorset Industries Pvt. Ltd. Vs. Landmark Housing Projects Chennai CS (COMM) No. 684/19 21.01.2020. Present : Ms. Parul Chopra, ld. Counsel for the plaintiff with Authorised Representative. Despite opportunity afforded, no amendment are carried out in terms of provisions of Commercial Courts Act 2015 particularly with respect to the filing of statement of truth under Order 6 Rule 15A and under Order 11 Rule 3 CPC as amended for Commercial Courts Act, 2015 and claim of interest under Order 7 Rule 2A CPC as amended for Commercial Courts Act, 2015. Be that as it may, I have gone through the contents of the plaint. This is a suit for recovery of Rs.10,61,407/-, brought by the plaintiff with respect to supply of goods/material to the defendant vide various invoices, with respect to which defendant has not made any payment. The copies of the invoices along with delivery receipts have been placed on record. On examining the documents, it is apparent that goods/material were supplied to the defendant by the plaintiff. Vide invoices/delivery receipts which pertain to the period November 2015 to March 2016. The suit for recovery for price of goods sold and delivered can be brought within three years from the date of the delivery of the goods in terms of Article 14 of the Schedule attached to Limitations Act 1963. In the present case, the goods were delivered on various occasions from period November 2015 to March 2016. The suit has been filed in November 2019 i.e. beyond the period of three years i.e. after the expiry of statutory period of limitation. The legal notice dated 28.11.2018 would not extend the period of limitation. The suit of the plaintiff is therefore barred under the Limitation Act 1963. The plaint is accordingly rejected.
