The impugned notice issued in Lr.No. NGT/PCB/RO/RCP12019- 497 dated 06-1 1- 2019 by 2nd Respondentas lacking authority of law, in view of the fact that Petitioner's Company is not located in Patancheru or Bollaram, further the same is wholly outside the contours of Environment Protection Act, 1986 and so also against the Judgment of Hon'ble National Green Tribunal Chennai Bench in Application No. 69 of 2013 and batch dated 24-10-2017, thereby amply further disclosing non-application of mind, therefore in derogation of Articles 14, 19, 21 , 265 and 30-A of the Constitution of lndia, consequently to set aside the same; ll. The impugned G.O, Ms. No.31of 2019 dated 24-05-2019 issued by 1't Respondent, directing remittance to the corpus fund in the name of PBERF @ 1% of annual turnover for expansion and 0.5% of the previous year's annual turnover for remedial measures, despite the Petitioner Company does not fall in the Patancheru and Bollaram lndustrial Development Area and also for the reason that the operational guidelines so framed are arbitrary, illegal and violative of Articles 1 4 and 1 9(1 )(g) of the Constitution of lndia and per contra to the Judgment of Hon'ble National Green Tribunal [Chennai Bench] in Application No. 69 of 2013 and batch and also subversive of the provisions of the Water (Prevention and Control of Pollution) Act, 1971 and the Air (Prevention and Control of Pollution) Act, 1984 and rules framed thereunder and consequently, direct the Respondents to consider the application of the Petitioner Company for expansion of unit without reference to operational guidelines issued pursuant to G.O. Bulk Drug Manufacturers \ssociation of lndia, an Association oi Drug Manufacturers, r Las filed this present petition being aggrieved by the action of tl e Telangana State Pollution Control Board in issuing the imp rgned guidelines to make contribution towards Corpus Fund a the rate of 1% of the annual turnover for expansion of inr ustries and 0.57o of the annual turnover for restoration of th( entire affected area and for creation of Corpus Fund in the name of "Patancheru and Bollaram Environment Relief Fund" etc. The u rdisputed facts of the case also make it very clear that the entire ixercise has been initiated on account of the judgment dated 24.lO.2017 delivered by the National Green Tribunal, Souther r Zone Bench, Chennai, in Application No 90 of 2013 and batch. A similar ( ontroversy arose in respect of M / s Cl-rromo Laboratories lndi r Limited and M / s Suven Pharm€tcellticals Limited, having l1eir units at Sangareddy District' Telangana' M/s.
