The plaintiff has instituted the present suit on 12th October, 2012 and has sought vacant and peaceful possession of the suit premises alongwith mesne profits. 2. After institution of suit, summons was issued to the defendant and he appeared vide Exhibit9. Thereafter, inspite of ample and liberal opportunities, defendant failed to file written statement within stipulated period of 90 days. Thereafter, the suit was posted for hearing and it was incumbent on the part of the plaintiff to adduce evidence. But inspite of ample and liberal opportunities , 2 plaintiff has failed to adduce evidence. It appears that plaintiff is not interested in prosecuting the suit .
