As per the complaint, the accused in discharge of his  liability issued cheque bearing no.538006 dated 28.12.2013 for  Rs.6,00,000/­  in   favour of   the complainant.  The said  cheque  were   deposited   in   the   bank,   which   were   dishonored   with  2 M/s Universal Feeds Indain Vs. Rajesh Kumar remarks   “Insufficient   Funds”   vide   memo   Ex.   C.3.  The  complainant   informed   the  accused   regarding  dishonor  of   the  cheque and also served upon the accused a legal notice dated  10.3.2014 failing which the present complaint has been filed.  2. In order to support the complaint, complainant filed  documents Ex.C.1 to Ex.C.10. 3. Complainant   has   complied   with   the   mandatory  formalities under Section 138 of the Negotiable Instruments Act  and the complaint is hereby completely corroborated with the  evidence  of   the  complainant.  As  a   result,   I  hereby  order   the  summoning  of  accused  under  Section 138  of   the  Negotiable  Instruments Act for 3.6.2015 on filing of PF, copy of complaint,  list of witnesses etc., as per provisions of law.  Announced in open Court.      (Tayyab Hussain) Dated: 8.4.2015 Sub Divisional Judicial Magistrate,       Loharu. M/s. Universal Feeds. Vs. Rajesh  Present: Complainant with Shri VS Chauhan, Advocate.  Today   the   case   was   fixed   for   summoning   of   accused.  However, at this stage, perusal of complaint shows that the bank of  the   complainant   is   situated   Jind   and   therefore,   in   view   of   the  ordinance   'The   Negotiable   Instruments(Amendment)   Second  Ordinance,  2015 No.7 of  2015',   the  jurisdiction to  try the present  complaint rests with the Court where the bank of the complainant is  situated i.e. Jind. As such, complaint in all respect be sent to learned  Chief   Judicial   Magistrate,   Jind   for   his     perusal   and   necessary  directions   for   22.12.2015.   The   parties   are   directed   to   appear   on  22.12.2015 before the court  of   ld.  Chief  Judicial  Magistrate,  Jind.  Ahlmad is  directed to send the case file  to the Ld.  Chief  Judicial  Magistrate, Jind complete in all respects at once.
